Understanding Mahar

Dowry as a gift to a wife is often misunderstood by most people, this is because in our homeland there are various traditions that are different in each region regarding giving to the bride both before the contract, during the contract, and after. There is even a tradition in an area in Indonesia where it is the woman who hands over valuables to the groom. So how exactly is Mahar referred to in Islamic law?

Mahar definition

a. Language

In language, dowry is interpreted as property given by a husband to his wife with a marriage contract.

b. Term

While dowry is defined in different terms by madzhab scholars as follows:

- Al Hanafiyah: Property that is the right of a woman because of marriage or sexual relations.

- Al Malikiyah: Property handed over to the wife as a reward for having intercourse with her lawfully.

- Asy Syafi'iyah: Assets that must be surrendered because of marriage, sexual relations or loss of virginity.

- Al Hanabilah: The reward for marriage.

From all the definitions above, we can draw a conical conclusion that Mahar is a property given by a husband to his wife as a reward and appreciation for his willingness to be lawful to marry.
