The criminal legislation of the Republic of Kazakhstan consists of this Criminal Code of the Republic of Kazakhstan. Other laws providing for criminal responsibility shall be applied only after their introduction into this Code. This Code is based on the Constitution of the Republic of Kazakhstan and universally recognized principles and norms of international law. The Constitution of the Republic of Kazakhstan has a high legal force and is directly applied in the entire territory of the Republic. In case of conflict between this Code and the provisions of the Constitution of the Republic of Kazakhstan, the provisions of the Constitution shall apply. The norms of this Code recognized as unconstitutional, including those that undermine the rights and freedoms of a person and a citizen established in the Constitution of the Republic of Kazakhstan, shall be null and void and shall not be applicable. Regulatory decisions of the Constitutional Court and the Supreme Court of the Republic of Kazakhstan are a component of the criminal legislation of the Republic of Kazakhstan.
